TERMS OF USE OF THE MANO EVENT APS ON SINCH APPLICATION

- Definitions
- Terms capitalized in these Terms of Use have the following meanings:
- Terms of Use: these terms and conditions;
- Application: the online application OnSinch available on the Web;
- Web: https://manoevent.onsinch.com/
- Agreement: the contract for the use of the Application concluded between the Administrator and the User;
- Administrator: the company Mano Event ApS, Company ID: 35636536, as the administrator of the Application;
- User: an individual with a User account registered in the Application;
- User Account: the user interface for utilizing Application functionalities by a registered User;
- Contact Email: manoevent@manoevent.dk
- Civil Code: Act No. 89/2012 Coll., Civil Code, as amended;
- GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC
- Introductory Provisions
- These Terms of Use for the Application issued by the Administrator govern the legal relationships related to the use of the Application by the User.
- These Terms of Use apply to the legal relationships between the Administrator and the User during the use of the Application, as they form an integral part of the Agreement which the User enters into with the Administrator by clicking the “Register” button after filling out the registration form on the Web. The expression of consent to the Terms of Use is a prerequisite for User registration and the creation of their User Account.
- The Application allows the User to register for specific work activities arranged by the Administrator for various clients, receive remuneration from the Administrator for work or services rendered, request the transfer of funds to the User’s bank account, fill in personal data and further manage and change it, as well as perform other activities enabled through the Application settings by the Administrator.
- Registration and Maintenance of User Account
- A User Account is created for the User at the moment of entering into the Agreement, or upon registration confirmation according to clause 3.5.
- The Contract is concluded electronically by clicking the “Register” button on the Web after properly filling out the registration form published there and expressing consent to the Terms of Use and acknowledging the Data Protection Policy document by checking the respective boxes.
- During registration, the User must provide their first name, last name, email address, phone number, date of birth, gender for the purpose of preparing employment documentation, and a password. The User is responsible to the Administrator for the completeness and truthfulness of the data entered in the form. The Administrator considers the data entered in the form as complete and truthful.
- The Administrator may require the User to confirm registration via a link sent to the email provided by the User in the registration form. If such confirmation is required, the User is obliged to complete it according to the instructions for proper registration and account creation.
- The Administrator may ask the User, in case of doubts about the accuracy of the data entered in the registration form or later in the User Account, to verify their correctness and truthfulness. If the User does not comply within a reasonable period, the Administrator may block the User Account and terminate the Agreement.
- The User logs into the Application via their User Account, using their login (their email address) and password provided during registration.
- Management of the User Account
- Each User may have only one active User Account.
- The User is not authorized to allow third parties to use their account and must maintain confidentiality regarding the login credentials used to access the Application. The Administrator is not liable for damages caused by the User’s breach of this obligation.
- A lost or forgotten password can be reset by the User following the procedure after clicking on “Forgot Password” button beneath the login form.
- In case of any objective change in the data provided during registration, the User must report the change to the Administrator by updating their data in the Application via User Account. The User understands that the first name and last name provided during registration cannot be arbitrarily changed afterwards.
- The User acknowledges that their User Account may not be available continuously. The Administrator reserves the right to change or cease providing any service within the Application or perform hardware or software maintenance resulting in temporary unavailability of the Application without prior notice. The Administrator is not liable for damages caused by changes or unavailability of the Application.
- Any issues with the User Account or the Application should be reported by the User without undue delay after discovery to the Contact Email. The User may also submit a report via the relevant form within the Application.
- Use of the Application
- The use of the Application is permitted after the conclusion of the Agreement – i.e. successful completion of registration.
- The Application may only be used in accordance with these Terms of Use and generally applicable legal regulations.
- Upon first use of the Application, the User must become acquainted with the Rules of Work for the Administrator, if issued, and with the Help section of the Application, which are available after logging into the Application.
- The User is obliged to adhere to the general principles of workplace safety concerning the User Account, particularly to protect login credentials and passwords from unauthorized access, and to log out of the Application immediately after finishing using it.
- The User is responsible for all activities carried out through their User Account. If the User becomes aware that their User Account has been misused by a third party, they must immediately inform the Administrator in writing (e.g. via email).
- Within a reasonable period after receiving the notification described in the previous clause, the Administrator will block access to the Application for the respective User Account. Access will be restored only upon the User’s written request delivered to the Administrator, who is entitled to verify the User’s identity by appropriate means.
- Unless otherwise specified, managing the User Account is free of charge. The User acknowledges and agrees that certain premium functions of the Application may be charged. A price list of charged functions, if implemented, is accessible to the User after logging into the Application.
- If the Application settings allow, the User is permitted to request transfer of funds displayed in the Application to their bank account maintained with their bank in accordance with such transfer instruction. The User is further entitled to request a cash payout of the funds displayed in the Application. Cash payouts are carried out on pay days at the Administrator’s office. Request for transfer of fund or for a cash payout may be made for full amount or part thereof.
- It is prohibited to use the Application with the intent to harm others or adversely interfere with their rights and freedoms, especially to commit acts constituting an offense or crime, to use vulgar language, to unlawfully publish commercial messages, or to spread data or links containing computer code capable of adversely affecting hardware or software functionality. Content contrary to the previous sentence may be deleted by the Administrator from the Application without prior notice.
- By entering into the Agreement, the User does not acquire any rights or licenses to the source code of the Application, its graphical user interface, or other components or elements protected by intellectual property law.
- The Administrator is responsible only for the content published by him within the Application.
- Termination of the User Account
- The User may delete their User Account if the account balance of funds in the Application is zero. Termination of the User Account results in the extinction of the obligations under the Contract.
- If the User breaches any obligation arising from the Contract, these Terms of Use, or generally applicable legal regulations in connection with the use of the Application, the Administrator is entitled to block their User Account immediately.
- The Administrator reserves the right to block the User Account if the User does not log into the Application via their User Account for longer than 3 years.
- Communication with the User
- The Administrator delivers all notices to the User by displaying them within the User Account, via email to the email address provided by the User, or by sending them to the delivery address provided by the User in the Application or registration form.
- The Administrator is entitled to choose which of the abovementioned methods of notification to use. Notices shall be considered delivered by being displayed in the User Account or, if sent via email given to the Administrator by the user unless the Administrator receives a notification that the email was not delivered.
- Protection of Privacy
- The Administrator acts as the controller of the User’s personal data uploaded by the User to the Application within the meaning of GDPR.
- Information on the processing of personal data pursuant to Article 12 of GDPR is provided to the User in the Privacy Policy document, which the User becomes acquainted with before concluding the Agreement and which can be viewed at any time within the Application.
- Additional information on data processing may be provided by the Administrator by notices and links published in the Application.
- Final Provisions
- The legal relationships between the User and the Administrator are governed by these Terms of Use and relevant laws of the Denmark.
- If any provision of these Terms of Use is or becomes invalid or unenforceable, it shall be replaced by a provision meaning of which most closely approximates that of the invalid or unenforceable provision. The invalidity or unenforceability of a particular provision does not affect the validity of the remaining provisions of the Terms of Use.
- The Administrator may unilaterally modify or amend these Terms of Use at any time. The User will be informed of any changes without undue delay, always upon their first login to the Application after the amendment of the Terms of Use.
